By posting and uploading User Submissions that you have tagged with #seizethebug, #mybugidea or other SkiJitsu, LLC brand hashtags, you grant to SkiJitsu, LLC and its subsidiaries and affiliates, (“SkiJitsu”) and SkiJitsu, LLC’s third-party service providers who provide content management services (collectively, the “Licensed Parties”) the perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your SkiJitsu, LLC-tagged User Submissions in any manner to be determined in SkiJitsu, LLC’s sole discretion. This grant includes, but is not limited to, use of the User Submissions on SkiJitsu, LLC social media pages (including but not limited to Facebook, Instagram, Twitter and Pinterest) and on SkiJitsu, LLC websites (including but not limited to seizethebug.com), and in other SkiJitsu, LLC marketing, promotional and advertising initiatives, in any media now or hereafter known. SkiJitsu, LLC may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Submissions in any manner in its sole discretion, with no obligation to you whatsoever.

You grant SkiJitsu, LLC the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Submissions. You hereby represent and warrant that: (i) you are at least 18 years old or the legal guardian of a minor; (ii) you are the owner of your User Submissions; (iii) the User Submissions do not infringe someone else's copyright, trademark, proprietary rights or rights of publicity and privacy; (iv) the User Submissions do not violate a law, statute, ordinance or regulation; and (v) if the User Submissions contain the likeness and/or name of an identifiable person, you have that person's permission to include their likeness and/or name in the User Submissions. You are solely responsible for your User Submissions, and SkiJitsu, LLC assumes no liability for any User Submissions.

SkiJitsu, LLC will not be liable for damages of any kind, including without limitation special or consequential damages, arising out of your access to, or inability to access, your User Submissions or your use of, or reliance upon, this language or the site(s) where your content is located. Further, SkiJitsu, LLC is not responsible nor liable for your use of other web sites which may have access to your User Submissions. You further irrevocably waive any "moral rights" or other rights with respect to attribution of authorship or integrity of materials regarding User Submissions that you may have under any applicable law under any legal theory.
